Our colleagues Katja Kovačič and Neža Poglajen published in World Trademark Review (WTR) an article concerning an opposition case involving the well-known Austrian company Red Bull (Opposition No B 3 208 066, 6 March 2025).
While both Red Bull’s marks and the contested sign featured red-coloured animal(s) against a yellow circular background, the Opposition Division found that significant differences outweighed these similarities.
Since the publication of the article, Red Bull appealed the decision; therefore, the proceedings are still pending.
